NATIONAL ENVIRONMENTAL MANAGEMENT: WASTE ACT, 2008 (ACT NO. 59 OF 2008)
NOTICE OF APPLICATION FOR THE EXCLUSION OF A WASTE STREAM OR A PORTION OF A WASTE STREAM FOR BENEFICIAL USE FROM THE DEFINITION OF WASTE
The Minister of Environmental Affairs, under regulation 6(3) of the Waste Exclusion Regulations, 2018, published under Government Notice No. 715in Gazette No. 41777 of 18 July 2018, read with sections 72 and 73 of the National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008), give notice of her intention to make decisions on the applications for the exclusion of certain waste streams or a portion of such waste streams, from the definition of waste, for the purposes of certain beneficial uses. The beneficial uses under consideration for the waste streams are indicated in the Schedule to the Government Notice. The waste streams under consideration are waste slag from ferrochrome metallurgy; ash from combustion plants; gypsum from pulp; paper and cardboard production and processing; as well as biomass from pulp, paper and cardboard production and processing.
In consideration of the applications, the criteria contemplated in regulation7 and the risk assessment contemplated in regulation 8 of the Waste Exclusion Regulations, 2018, must be taken into account. Once a waste stream has been excluded from the definition of waste, a risk management plan, which is based on the risk assessment, must be complied with; and there is also an annual reporting requirement, in terms of regulation 11, to the Department of Environmental Affairs. Members of the public are invited to submit written representations or objections to the Minister, within thirty (30) days from the date of the publication of the Government Notice in the Government Gazette, to the following addresses:
